办理公证及各种证明书的常见问题
一、 哪些人可以作为公证申请人？
1． 具有民事权利能力和民事行为能力的人都可以亲自申办公证；
2． 限制民事行为能力人应征得其法定代理人的同意后才可办理申办公
证，或由其法定代理人代办公证；
3． 无民事行为能力人应由其法定代理人代理申办公证。
二、是否可以委托他人代理申办公证？
1． 申请公证的当事人可以委托他人代办公证，但申办遗嘱、遗赠抚养协
议、收养、赠与、声明、委托、生存等公证事项除外。
2． 委托他人代办公证，必须向公证处提交委托书。公证申请人应在委托
书将受委托人和委托申办的公证事项写得具体、明确、详细、完整，
并由委托人签名盖章。如委托申办的公证事项须使用当事人出生时间
的，应在委托书上声明以公证处查实的国内户籍记载为准。
3． 当事人委托办理涉及产权转移等重大公证事项的，其委托书应经公
证，有的还须经我驻外使领馆认证。
三、 申办公证一般应提交哪些证件？
1． 能证明申请人身份的户口簿和身份证。集体户口人员应提交由户口所
在派出所或单位保卫部门出具的集体户口证明，内容应包括：什么单
位的集体户口，集体户口所在的地址，以及集体户口中当事人的姓
名、性别、出生时间等全部项目记载。
2． 已获得护照、通行证的应提交护照、通行证，已出境的应提交护照、
通行证的复印件（除空白页外的每一页都须复印，而且要清晰可见，
特别不要遗漏盖有出境日戳的那一页）。
3． 申请人或关系人在境外居住的应提供有姓名、性别、出生日期的境外
身份证、居住证、护照或驾驶证等证件的复印件。
4． 须在公证书中使用“又名”、“外文名”的，应提交有关证明材料。
5． 代理人代为申请的，除委托代理人提交委托书，其他代理人应提交有
代理权资格的证明外，都须提交他们的身份证明。
6． 前来本处作证的证明人，应携带本人的居民身份证和户口簿。
7． 具有大专以上学历的人员（含在读生），申请自费出国留学或就读语
言申办公证者，须提供所在单位组织、人事部门出具的同意其申办有
关公证的证明（在读生须提供在读学校证明），申请人如无工作单
位，可由其所在街道办事处或乡镇政府出具证明。
四、 公证当事人提出公证申请时应注意些什么主要问题？
公证当事人必须如实填写公证申请表，回答公证人员必要的询问。对
于故意向公证机关公证机关提供假情况、假证明的，将拒办公证。对
审查中发现的当事人或有关人员的违法行为，公证机关将责令其改
正，并有权向主管部门发出司法建议书。
五、办理哪些公证需要提交照片？
申办出生公证须交二寸近期免冠照三张（去美国定居交四张）；申办
结婚公证须交男女双方二村近期免冠各三张（去美国定居的各交四
张）；申办学历和工作经历公证均须交二寸近期免冠照三张。提交的
每张照片背面都应写上其姓名。公证申请人在境外的须提供照片与申
请人相一致的证明。
六、 申办公证时应使用何种书写工具？
填写公证申请表、书写委托书和所有的证明材料，都应使用钢笔和毛
笔，不能用圆珠笔书写。
七、办理公证需要多长时间？
公证事项一般自受理之日起一个月内办结。公证申请受理后需当事人
补充提供证明材料和照片的，应从通知之日起一个星期内用挂号信寄
达或送交公证承办人员，逾期不寄达或送交者，办证期顺延。由公证
处代送市外办、外交部和外国驻华使领馆认证的公证文书，认证期间
不计入上述办证期限。
八、 领取公证书需要哪些手续？
公证书由当事人或其代理人到公证处领取。领取时须带好领取人的
身份证、领证通知书和公证费收据。代理人代领的，还须提交委托
书。领取公证书时，如经核定的公证费数额与预收数额不一致的，
应办理退还或补收手续。
九、 可否申办公证书副本？
当事人根据需要，可在申办公证时，申请若干份公证书副本。需张
贴照片的公证事项，申办副本的相应增交照片。
证明材料一般出自有关单位，文字应规范、严谨，并加盖有效印章。申请者应提供的证明材料主要有以下几种：
1 学历、学位证明，主要是大学、研究生毕业证书，硕士学位证书，博士学位证书；
2.成绩单，成绩单是任何申请人都必须提供的，我国大专院校的成绩评定大多采用百分制，而美国则以采用等级制为多，其平均值通常用平均成绩点数（GPA）表示，因此，必须注明所采用的记分方法，最好能提自己在班级所排名次，现在，美国大多数学校都要求申请者通过ETS直接提供TOEFL或GRE成绩：
3. 财力证明；
4. 体检表和健康证明，一般应由指定级别的医院出具；
5. 学业（术）奖励和工作证明，一般学校尽管不作要求，但获得过奖励和有过实际工作经验的申请者，在录取时必定会得到优先考虑，这一点在申请助教、助研及奖学金时尤为重要。
范例1 大学毕业证书
